Expressive Activities

(Time, Place, Manner)

 

Students and employees of Ventura College and members of the public may exercise their rights and free expression, subject to the time, place, and manner policies and procedures located in BP 3900 and AP 3900  (Speech: Time, Place, and Manner) and this process.

Areas generally available to students and the community are defined as grassy areas, outdoor walkways, and other similar common areas, except otherwise authorized by law and/or by BP 6700  and AP 6700  (Facilities Use). The areas generally available to students and the community are designated public forums. These areas provide visibility and allow communication to a large number of students, administrators, faculty, and others walking or traveling on campus, but also so as to not disrupt education and other activities of the College. 

Areas generally available to students and the community do not include the following areas, which are nonpublic forums:

  • Areas within 25 feet of doorways open to outdoor areas of campus;
  • All “Interior College Property,” which is defined for purposes of this regulation to include all interior portions of College facilities, including, without limitation, administration buildings, classrooms, library, learning centers, indoor cafeteria/food service facilities, lecture halls, residence halls, studio spaces, laboratories, computer rooms, bookstore, campus offices, performing art facilities, indoor athletic facilities, warehouses, maintenance building and areas within the outdoor athletic facilities, parking lots, and maintenance yards and areas.

Anyone wishing to engage in speech or expressive activities on campus in areas designated as public forums should contact the Office of the Vice President of Student Affairs.

No illegal activities will be permitted, no activities that violate District policies, including policies and laws on illegal harassment and/or discrimination, and none/ that will substantially interfere with or disrupt activities already scheduled for that day and time in the designation areas as described in BP 3900 and AP 3900. 

In the event the area sought to be used for expressive activities has already been reserved for another activity so that there will be substantial interference or disruption based on noise, overcrowding, or other considerations unrelated to the content, the College will offer alternative available areas or if none is available, offer alternative dates.

Distribution of Materials

All persons using the areas that are designated public forums shall be allowed to distribute petitions, circulars, leaflets, newspaper, and other printed matter. Such distribution shall take place only within those areas. Those persons distributing printed materials must make reasonable efforts to retrieve, remove, or properly discard material that is discarded or dropped in or around the areas other than in an appropriate receptacle, prior to their departure from the areas that day.

Obscene, Defamatory, or Materials that Incite Violence

Nothing in Administrative Procedure 3900 shall be deemed to permit the distribution of materials that is obscene, defamatory, or incites violence, the violation on law, Ventura County Community College District policies and/or procedures, or the commission of unlawful acts on College property or at a College controlled, managed, and/or sponsored event or activity.

Copyrighted Materials and Trademarks

The College and District disclaims any responsibility for any alleged violation of copyright trademark, or service mark laws regarding any material that is set forth in any writing or distributed on its property by persons who are not College or District employees. Persons utilizing College or District facilities are advised not to violate copyright or trademark laws.

Posting

Bulletin boards shall be provided for use in posting materials at campus locations convenient for use of students, employees, and members of the public. All materials displayed on a bulletin board shall clearly indicated the author or agency responsible for is production and shall be dated with the date of posting by Ventura College Vice President of Student Affairs or designee. Materials displayed shall be removed after the passage of at least ten (10) days.
